The writ application has been preferred praying for direction upon the respondent District Magistrate, Paschim Bardhaman, to forthwith initiate and proceed with the execution of the Recovery Certificate bearing No. M.W. 13 of 2025 dated 30.06.2026 issued by the Regional Labour Commissioner (Central), Asansol under Section 20(5)(b) of the Minimum Wages Act, 1948, and to take immediate coercive steps for recovery of the adjudicated amount of Rs. 33,61,100/- from M/s Innovative Mining Projects Pvt. Ltd. 3. On hearing the learned counsels for the petitioners who appears virtually and on perusal of the materials on record, it appears that an order dated 20th May, 2026 was passed in claim application no. M. W. 13 of 2025 by the authority under the Minimum Wages Act. On 30.06.2026 the said authority issued a recovery notice to the 2 respondent no.2 in the present case for necessary compliance of the said order. It appears that the petitioners without approaching the appropriate authority for conducting an early hearing has approached the High Court directly. 4. Considering the said fact, the writ application is disposed of with liberty granted to the petitioners to move the respondent no.2 for an early and expeditious hearing of the said recovery proceeding. 5. The writ application stands disposed of. 6. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties after completion of all necessary formalities.
