Accused no.6 in Crime No.109/2026 registered by Koratagere Police Station, Tumakuru District, for the offences punishable under Sections 310(4), 310(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.109/2026 was registered by Koratagere Police Station, Tumakuru District, against six unknown persons for the aforesaid offences based on the first information dated 14.05.2026 received from Theerthesha, Police Officer attached to Koratagere Police Station. In the said case, petitioner was arrested on 28.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.5205/2026 was rejected on 15.06.2026. Therefore, petitioner is before this Court. 4. FIR in the present case was registered against unknown persons based on the first information submitted by the Police Officer attached to Koratagere Police Station. In the first - 3 - HC-KAR CNR: KAHC010472322026 NC: 2026:KHC:43304 CRL.P No. 10194 of 2026 information, it is stated that the officer had received credible information that about six persons armed with deadly weapons had prepared themselves to commit dacoity. In the raid that was conducted subsequently to the alleged spot where the accused persons had gathered, the accused was apprehended and from their possession, weapons which they possessed were recovered. 5. It is not in dispute that petitioner do not have any criminal antecedents. Petitioner is aged 20 years. Major portion of the investigation has been completed. The alleged offences are not punishable with death or life imprisonment. Accused nos.3 to 5 have been granted regular bail by this Court in Crl.P.No.9538/2026 disposed of on 27.07.2026. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.109/2026 registered by Koratagere Police Station, Tumakuru District, for the offences - 4 - HC-KAR CNR: KAHC010472322026 NC: 2026:KHC:43304 CRL.P No. 10194 of 2026 punishable under Sections 310(4), 310(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
