1. After arguing for some time learned counsel for the petitioner prays for withdrawal of the present writ petition with liberty to move appropriate application for fresh demarcation of the subject land before the learned trial Court. He would further submit that in the eventuality of filing of the application for demarcation of the subject land by the petitioner, the learned trial Court may be directed to consider the same in accordance with law.

In view of the submission made by learned counsel for the petitioner the present writ petition is disposed of as withdrawn reserving the aforesaid liberty in favour of the petitioner and it is directed that in the eventuality of filing of application by the petitioner for demarcation of the subject land before the learned trial Court, the learned trial Court shall consider the said application in accordance with law on its own merits.
