CORAM:
HON’BLE MR. JUSTICE MOHD YOUSUF WANI, JUDGE
ORDER 16.09.2026
1. Pursuant to the response filed by the learned counsel appearing for respondent No. 3, duly supported by an affidavit, there appears to be no dispute or variance between the parties as of now.
2. The petitioner alleging a duly registered Micro, Small and Medium Enterprise (MSME) Small Scale Industries (SSI) Unit Holder, registered on 07.07.2026 has through the medium of the instant petition expressed its grievance of unauthorized interference and obstruction being caused to it by certain unsuccessful participants/unit holders in the execution of the works namely “Construction of Garage Devri Stone Gate near Main Road and Wood Panelling Flooring of BCA Establishment Physics Lab Department as Govt. Degree College for Women Sopore”, lawfully allotted to it after compliance of the codal formalities by the intending department.
3. The petitioner has accordingly sought for issuance of directions/writs in the nature of mandamus for commanding the respondents to permit and facilitate it to execute the subject work already allotted to it vide order dated 27.08.2026 strictly in accordance with the terms and conditions of the said allotment.
4. It is now revealed from the reply affidavit filed by respondent No. 3 that the petitioner-firm was temporarily restrained from executing the subject work on account of its failure to produce the allotment order issued by SICOP, the agency to which the work had been allotted for execution.
5. It is revealed from the perusal of the affidavit that petitioner firm subsequently produced the allotment order before Respondent No. 3 and has been allowed to proceed on the execution of the work. There seems nothing to be left out for adjudication.
6. The instant writ petition is, accordingly, allowed. The respondents, particularly respondent No. 3, are directed to permit the petitioner to execute the allotted work strictly in accordance with the terms and conditions of the allotment
order, without any interference or obstruction from any quarter.
7. Disposed of.
