THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE V SRISHANANDA ORAL ORDER 1. After addressing the arguments for sometime, a memo came to be filed by the learned counsel for petitioner. Learned counsel for the respondent has endorsed no objection on the memo. The contents of the memo reads as under; "1) The petitioner above named most respectfully submits that he had challenged the order of learned Appellate Court at II Addl. District & Sessions Judge, Mandya, in Crl.App.No.359/2021, which had confirmed the order of Judgment of the learned Civil Judge and JMFC-5 at Maddur in CC No.1887/2016 hence he has preferred the above revision petition. 2) At the time of final hearing in this above petition with the intervention of elders, the matter came to be amicably settled on the following conditions. - 3 - HC-KAR NC: 2026:KHC:18632 CRL.RP No. 1027 of 2022 3) The petitioner is ready and willing to settle the entire claim of the respondent to the tune of Rs.2,80,000/-. 4) The petitioner has already deposited a sum of Rs.1,42,500/- before the learned Magistrate in CC No.1887/2016 before the IV Addl.Civil Judge & JMFC, Maddur during the pendency of this revision petition. 5) The petitioner is ready to deposit the balance amount of Rs.1,37,500/- in 3 months as follows:- a) I installment amount will be paid on 10 May 2026 a sum of ` 45000/- before the learned Magistrate. b) II installment amount will be paid on 10 June 2026 a sum of ` 45,000/- before the learned Magistrate. c) III installment amount will be paid on 10 July 2026 a sum of ` 47,500/- before the learned Magistrate. Therefore, the petitioner above named most respectfully prays that this Hon'ble Court may be pleased to take the same on record and pass necessary orders in the interest of justice." - 4 - HC-KAR NC: 2026:KHC:18632 CRL.RP No. 1027 of 2022 2. Placing the memo on record, the petition stands disposed of. 3. The amount in deposit is ordered to be withdrawn by the complainant under due identification. 4. It is made clear that if the compensation amount as agreed in the memo is not paid, the petitioner shall undergo imprisonment as ordered by the Trial Magistrate confirmed by the First Appellate Court. 5. After payment of the entire compensation amount, a sum of Rs.5,000/- imposed by the Trial Magistrate confirmed by the First Appellate Court towards the defraying expenses of the State stands set aside.
