M/s Navyug India Ltd.
. . . . Petitioner Vs. Shri Pushpaj Kumar and another . . . . Respondents **** CORAM:
HON’BLE MR JUSTICE DEEPAK GUPTA
**** Present: - Mr.Rohit Bhardwar, Advocate, for the petitioner.
**** DEEPAK GUPTA, J. (ORAL) CM-14254-CII-2026
Application is allowed as prayed for. COCP-3388-2026 Petitioner seeks initiation of contempt proceedings against the respondents for alleged violation of the order dated 09.03.2026 passed by this Court in CM-8597-CWP-2025 in CWP-9627-2025 (Annexure P1). The operative part of the said order is as under:-
“Learned counsel for the petitioner does not dispute that an appeal against the said order dated 24.04.2023 has already been filed before the appellate forum u/s 19 of Foreign Exchange Management Act, 1999. The petitioner is well within its rights to raise all such contentions before the appellate forum, including that of non-supply of relevant material on the basis of which order dated 24.04.2023 has been passed, which is under challenge before the appellate forum. For the said purpose, writ jurisdiction of this Court need not be invoked and the petitioner is at liberty to raise all such grounds, including that of violation of principle of natural justice before the appellate forum. We say no further, lest the appellate forum may get prejudiced.

2.
It is clear from the abovesaid observations, as made by the Division Bench of this Court vide order dated 09.03.2026 passed in CM-8597-CWP-2025 in CWP-9627-2025 (Annexure P1) that the petitioner had been given liberty to raise the contentions before the appellate form and it was clearly stated that writ jurisdiction of this Court was not to be invoked.
