The prayer in the present petition under Section 483 BNSS is for the grant of regular bail to the petitioner in case bearing FIR No.132 dated 03.08.2025 under Sections 115(2), 118(1), 118(2), 126(2), 109, 191(3), 190, 324(4), 61(2) and 3(5) of BNS, 2023 (Sections 323, 324, 326, 341, 307, 149, 147, 448 and 376 of IPC), registered at Police Station Nangal, District Roopnagar. 2. The learned counsel for the petitioner contends that the petitioner is not named in the FIR but in the supplementary statement of the VISHAL SETHI 2026.07.23 10:46 I attest to the accuracy and integrity of this document CRM-M-14674-2026 (O & M) ::2:: complainant. Even in the said statement, no role has been attributed to the petitioner. As the petitioner is in custody since 05.08.2025 but none of the 22 prosecution witnesses has been examined so far, the Trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of regular bail. 4. The learned counsel for the State, on the other hand, contends that in the present occurrence, one Ramandeep Singh has caused injuries on the person of Daljit Singh severing his arm. Therefore, the nature of allegations levelled against the co-accused of the petitioner do not entitle the petitioner to the concession as prayed for. He, however, concedes that so far as the petitioner is concerned, no role has been attributed to him, that the petitioner is in custody since 05.08.2025 but none of the 22 prosecution witnesses has been examined so far. 5. I have heard the learned counsel for the parties. 6. The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. Admittedly, the petitioner is in custody since 05.08.2025 but none of the 22 prosecution witnesses has been examined so far. Therefore, the Trial in the present case is not likely to be concluded anytime soon. Thus without commenting on the merits of the case, the present petition is allowed and the petitioner-Sanjeev Kumar @ Sanju is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 8.
