SENIOR 4 CIVIL JUDGE AT UDUPI., REVERSING THE JUDGMENT AND DECREE DATED 19.06.2006 IN O.S.NO.246/2003 ON THE FILE OF THE LEARNED II ADDL. CIVIL JUDGE, (JR.DN.) JMFC., UDUPI, THIS APPEAL BE ALLOWED WITH COSTS THROUGHOUT IN THE ENDS OF JUSTICE THIS APPEAL COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED: CONCILIATION ORDER Both the parties filed joint memo for settlement and submits that the parties entered into settlement and seeks permission to withdraw the petition. 2. The joint memo for settlement is as below, JOINT MEMO The RSA. filed against the Judgment & Decree in O.S.246/2003 on the File of the II ADDL. CIVIL JUDGE AND JMFC, UDUPI and further R.A. No.28/2006 before Addl. Senior Civil Judge at Udupi., has been referred to this Lok Adalat by the Hon'ble High Court U/S.20 of the Legal Services Authorities Act.1987. The parties to the appeal have settled their claim before the Lok Adalat on the following terms: i. The Respondents would retain the extent of 9(nine) cents depicted as per report dated 14.10.2024 filed by the ADLR, Udupi; ii. The Respondents would pay the appellant a total sum of Rs.19,00,000/- spread over eight months in equal installments of Rs.2,37,500/- on or before the 10th day of each month by demand draft or RTGS; iii. Default in payment of any one installment would entitle the Appellant to rescind this agreement in which event, the Appellant would be entitled to enforce the Trial Court decree and pay back any 5 moneys received from the Respondents; iv. Upon payment of the final installment the Appellant or his successor – in –interest shall execute a deed of conveyance in favor of the Respondent on the date of such payment. The Appellant would ensure presence of all revenue records to enable such conveyance; v. The Respondent undertakes to remove the gate depicted as serial number 2 in the sketch, within three(3) months from today. The parties to this appeal have set their hands to this settlement before the Lok Adalat in the presence of Conciliators on this 11.07.2026 at Bengaluru Bench.
