Accused No.2 in Crime No.212/2022 registered by Tunga Nagar Police Station, Shivamogga, for the offences punishable under Sections 143, 144, 147, 148, 341, 504, 323, 324, 307, 506 and 149 of IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. Perusal of the material on record would go to show that petitioner, who was arraigned as accused No.2 in the FIR, that was registered in Crime No.212/2022 by Tunga Nagar Police Station, Shivamogga, was granted anticipatory bail by the Court of Sessions Judge in Crl.Misc.No.545/2022 by order dated 15.06.2022. It appears that subsequently, charge sheet was filed against seven persons and petitioner is arraigned as accused No.2 in the charge sheet. Since the petitioner had not appeared before the committal Court, coercive steps were taken against him and his presence was secured on 26.06.2026 and on the said date, he was remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court - 3 - HC-KAR CNR: KAHC010494692026 NC: 2026:KHC:44170 CRL.P No. 10787 of 2026 thereafter in Crl.Misc.No.661/2026 was rejected on 10.07.2026. 4. It is brought to the notice of this Court that in the other two criminal cases which are registered against the petitioner, he has been enlarged on bail. Insofar as the present case is concerned, petitioner was granted anticipatory bail by the jurisdictional Court of Sessions Judge in Crl.Misc.No.545/2022 by order dated 15.06.2022. Only for the reason that petitioner had not appeared before the Committal Court after the charge sheet was filed, steps were taken against him and he has been now remanded to judicial custody on 26.06.2026. Considering the aforesaid aspects of the matter and more so, the nature of allegations found against the petitioner in the charge sheet which is filed in the present case, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following order:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.212/2022 registered by Tunga - 4 - HC-KAR CNR: KAHC010494692026 NC: 2026:KHC:44170 CRL.P No. 10787 of 2026 Nagar Police Station, Shivamogga, for the offences punishable under Sections 143, 144, 147, 148, 341, 504, 323, 324, 307, 506 and 149 of IPC, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said - 5 - HC-KAR CNR: KAHC010494692026 NC: 2026:KHC:44170 CRL.P No. 10787 of 2026 Court until the case registered against him is disposed off.
