Advocate for the Respondent/ State. The present appeal has been listed today for final 2 hearing. When the matter was taken up for hearing, learned counsel for the appellant, as per instructions received by him, submits that the appellant has expired in jail, in which the learned State counsel would submit that he has to verify the fact of the death of the appellant. The Registrar General is directed to make necessary arrangement and to connect the Jail Superintendent of concerned jail at 12.00 PM in the present case through video conferencing to verify the fact that the appellant- Dinesh Yadav has died or not. Kokila Verma has appeared through virtual mode and stated that the sole appellant Dinesh Yadav has expired on 27.01.2026. In view of the aforesaid fact that the sole appellant- Dinesh Yadav has expired during the pendency of the present appeal, and no application has been filed by any of 3 sagrika his near relatives seeking leave to continue the appeal in terms of the proviso to Section 430 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 394 of the Code of Criminal Procedure, 1973), the present appeal filed by the appellant, Dinesh Yadav, stands abated. The concerned Jail Authority is directed to furnish the death report of the appellant, Dinesh Yadav, to the Office of the Advocate General, and a copy of the same shall be kept on record.
