1. Heard.
2. The present review petition has been preferred by the petitioner under Order 47 Rule 1 and Section 114 of the Code of Civil Procedure, 1908 (for short “CPC”) read with Rule 87 of the Chhattisgarh High Court Rules, 2007 (as amended), seeking
3 review/recall of the order dated 10.03.2026 passed by this Court in WP(C) No. 1018/2026.

Learned counsel for the petitioner submits that, in the impugned
order 10.03.2026 passed by this Court in WPC No.1018/2026, the petitioner was also a party as respondent No.8; however, the said
order has been passed without issuance of notice to the petitioner and without providing him an opportunity of hearing. He further submits that, on the strength of the aforesaid order, the State authorities are harassing the petitioner and threatening to evict him from the land in question, whereas the said land was allotted to him on lease (Patta). Learned counsel further submits that he had preferred a writ appeal bearing WA No.510/2026 challenging the aforesaid order dated 10.03.2026, but the same has been withdrawn with liberty to the petitioner to raise aforesaid grievance before this Court. Hence, he prays that the present review petition may be allowed, the order dated 10.03.2026 passed by this Court in WPC No.1018/2026 may be recalled, and the writ petition be restored to its original number.

Learned counsel appearing for the State fairly concedes that the impugned order was passed without service of notice upon the petitioner and without affording him an opportunity of hearing. However, he submits that this Court has not made any observation on the merits of the case and has only directed respondent -the Collector to consider and decide the application /representation filed by the petitioners therein.

5. Heard learned counsel for the parties and perused the impugned
order dated 10.03.2026.
6. A bare perusal of the order dated 10.03.2026 passed by this Court in WPC No.1018/2026 shows that this Court has not made any observation on the merits of the case. Rather, this Court has only
directed respondent No.2 -the Collector, Raipur to take an appropriate decision on the application dated 06.02.2026 filed by the petitioner therein, namely, Devki/Tevki Bai Tandan (respondent No.11 herein). However, the grievance of the petitioner is that, on the strength of the aforesaid order, the revenue authorities are threatening to dispossess him from the land in question, whereas, according to the petitioner, the said land was allotted to him on lease (Patta).

Since the impugned order was passed without issuance of notice to the petitioner and without providing him an opportunity of hearing, and since the writ appeal preferred by him has also been withdrawn with liberty to raise his grievance before this Court, this Court is of the view that the present review petition deserves to be allowed.
8. Accordingly, the instant review petition is allowed. The order dated 10.03.2026 passed by this Court in WPC No.1018/2026 (Devki Bai & Others v. State of Chhattisgarh & Others) is hereby recalled.

9. The Registry is directed to restore WPC No.1018 of 2026 to its original number and list the case before the appropriate Bench in accordance with the roster.
10. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
