ORAL JUDGMENT
(PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN)
This writ petition is filed seeking the following reliefs:-
"a) Issue a Writ of Mandamus, writ in the nature of certiorari or any other Order or direction requiring the Respondent No.2 to quash the RFP dated 29.02.2024 bearing No.BBMP/2023/24/SE0495(ANNEXURE-C) for procuring microchips for street dogs and microchip readers and implanting of microchips in the bodies of the stray dogs that can be scanned.
b) Issue a Writ of Mandamus, writ in the nature of certiorari or any other Order or direction requiring the Respondent No.2 to follow the Animal Birth Control Rules, 2023 while issuing tender notifications, with a declaration that the Respondents strictly adhere to the Prevention of Cruelty to Animals Act, 1960 and it's Rules, the Animal Birth Control Rules, as well as the orders of Hon'ble Supreme Court and to immediately stay the pilot project of microchipping of street dogs in Bengaluru as it is being carried out without any legal authority or sanction in terms of Animal Birth Control Rules 2023;
c) Issue a Writ of Mandamus, writ in the nature of certiorari or any other Order or direction against the Respondent No.2 by imposing exemplary costs and direction for compensation for the illegal benefits which were reaped by them due to the illegal exploitation by

microchipping of Street dogs in Bengaluru as it is being carried out without any legal authority or sanction;
d) Issue directions to the Respondent No.2 and Respondent No.7 to ensure Animal Welfare Board of India Orders (dated 19.03.2024 and 01.08.2024) are implemented, and to stop Animal Birth Control till infrastructure and certifications of NGO's NGOs are complied with and to conduct a detailed investigation into the functioning of all the NGO's.
e) Give directions to the Chief Secretary of Karnataka for strict implementation of Hon'ble Supreme Court Orders in SLP 691 of 2009, Prevention of Cruelty to Animals Act 1960 and Animal Birth Control Rules (Dogs) 2001 and including the Animal Birth Control Rules 2023."

Learned counsel appearing for respondent No.2 in this writ petition submits that in pursuance to the directions issued by the Hon'ble Supreme Court in the suo-moto matter, the tender which is complained of is not being proceeded with and there is no tender being quoted as of now with regard to microchipping of stray dogs.

3. In the above view of the matter, the writ petition filed seeking substantial relief with regard to quashing of the tender dated 29.02.2024 does not survive for consideration.
4. Recording the submission made by the learned counsel appearing for the respondents, the writ petition is closed without prejudice to the contentions.
5. The petitioner is also granted liberty to implead in the suo-moto petition initiated by the High Court, to agitate any further grievance which survive for consideration.
