GP FOR ENDOWMENTS The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.16658 of 2026 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue a Writ, Order or Direction, particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in issuing auction notice proposing to conduct a public auction on 24.06.2026 for grant of leasehold rights in respect of site with an extent of 114 Ankanams comprised in Sy.No.233/A situated in Door No.11/909, situated at Santhapeta, Nellore, SPSR Nellore District, without issuing notice to the petitioner and without determining the rights of persons in possession, as illegal, arbitrary, violative of the principles of natural justice and Articles 14 and 300-A of the Constitution of India and consequently set aside the said auction notification insofar as the petitioner's land is concerned and pass such other order or orders.…” 2. The respondents have issued an auction notification inviting bids from the stake holders to participate in the auction scheduled to be held on 24.06.2026 for grant of leasehold rights in respect of site admeasuring 114 Ankanams in Sy.No.233/A, bearing Door No.11/909, situated at Santhapeta, Nellore, SPSR Nellore District. Challenging the said notification, present writ petition has been filed. 3. Heard Sri Siva Prasad Reddy Venati, learned counsel for the petitioners and learned Government Pleader appearing on behalf of the Endowments Department. 4 4. Learned counsel for the petitioners restricted his arguments to a limited relief and sought a direction from this Court to permit the petitioners to participate in the auction scheduled to be held on 24.06.2026. 5. Learned Government Pleader, on instructions, fairly submitted that the petitioners will be permitted / allowed to participate in the said auction. 6. As the relief is innocuous, this Court is of the view that keeping the writ petition pending and inviting a counter-affidavit would serve no purpose. Therefore, with the consent of learned counsel appearing on either side, the Writ Petition is disposed of at the stage of admission, directing the respondents to allow the petitioners to participate in the auction scheduled to be held on 24.06.2026. There shall be no order as to costs.
