Order on Board 14/08/2026
1. By the present writ petition, the petitioner seeks a direction to the respondent authorities to consider and decide his pending representations in respect of pensionary benefits along with other retiral dues, in accordance with law.
2.
Learned counsel for the petitioner submits that the present petition is not directed against any specific order of the respondents, but against the non-counting of the petitioner’s past service rendered as a daily-wage employee for the purpose of pensionary and other retiral benefits. The petitioner was initially engaged as a daily- wage worker under the Forest Department prior to 1988 and was subsequently regularized as an Untrained Forest Guard. He superannuated on 30.11.2025 from the post of Forester (C.F.O.).
Learned counsel further submits that while settling his retiral benefits, the respondents failed to reckon his continuous daily- wage service rendered prior to regularization for the purpose of qualifying service, resulting in incorrect fixation of pension and computation of gratuity, leave encashment and other retiral dues. He further submits that despite repeated representations seeking correction of the pensionary benefits in accordance with the
3 applicable rules and circulars, the same have not been decided. Hence, the present petition.
3. On the other hand, learned State counsel would submit that for redressal of any grievance regarding retiral dues of a retired employee, the State Government has constituted a High Power Pension Redressal Committee and the representatives of the Accountant General are also member therein, therefore, it will be appropriate to refer the present matter to the said Committee, further the Committee shall decide the same in accordance with law.
4. I have heard learned counsel for the parties, perused the documents available on record.
5. Considering the limited prayer made by learned counsel for the petitioner and the submissions made by learned counsel for the respondents, this writ petition is disposed of with a direction to the petitioner to furnish a copy of the writ petition along with all relevant documents before the Office of the Advocate General within a period of one week. Upon receipt thereof, the Office of the Advocate General shall forward the same to the High Power Pension Redressal Committee within a further period of 15 days. The said Committee shall thereafter consider and decide the grievance of the petitioner regarding his pensionary benefits and other retiral dues, in accordance with law, after affording an opportunity of hearing to all concerned parties, as well as the
4 petitioner, and pass an appropriate reasoned order preferably within a period of 60 days thereafter.
6. With the aforesaid observation and direction, this writ petition is
disposed of. Sd/-
