2 been filed with regard to a case arising out of FIR No.401 dated 04.06.2021, for the commission of offence punishable under Sections 21(b) and 27-A of Narcotic Drugs and Psychotropic Substances Act, hereinafter being referred to as ‘NDPS Act’, Police Station Sadar Hisar, District Hisar. 4. The abovementioned FIR came into being at the instance of ‘ASI Mange Ram’, who had reported that on 04.06.2021 at about 03:30 pm, when he was leading a team of police officials, deputed for patrolling duty, he received a tip-off from a reliable source that petitioner and his co-accused were transporting Heroin in a Swift car, bearing registration No.HR70-E-
5078. As per above-named police officer, in response to abovementioned information, the abovementioned car was intercepted, wherein the petitioner and his co-accused ‘Jasbir Singh’ were travelling. As per above-named police officer, on search, 30 gms of Heroin was recovered. 5. It is the case of the prosecution that pursuant to recovery of abovementioned contraband, necessary formalities with regard to seizure & sealing of contraband, lodging of FIR, and formal arrest of the accused were completed, and further investigation taken up. 6. Heard. 7. The record has been perused carefully. 8.
A perusal of record shows that in the present case, following are the relevant factors which are required to be taken into consideration for a decision:-
i. that the cost of Rs.20,000/-, imposed by this Court while dealing with CRM-M-28045-2025, has been deposited by GAURAV THAKUR 2026.07.23 09:15 I attest to the accuracy and integrity of this document

3 the petitioner, photocopy of receipt thereof has been placed on record; ii. that the petitioner is already in custody for a period of more than four months and twenty one days, in this case; iii. that earlier also the petitioner was accorded the benefit of bail, but the same was withdrawn by the learned trial Court, as the petitioner did not appear before the learned trial Court on the date fixed; iv. that the quantity of contraband recovered from the possession of petitioner comes within the ambit of ‘non- commercial quantity’ i.e. 30 gms of Heroin. In fact the abovesaid quantity is marginally above the upper threshold fixed for small quantity of Heroin and only a fraction of lower limit fixed for ‘commercial quantity’ of the same contraband. Thus, rigors of Section-37 of NDPS Act are not attracted in the instant case; v. that the investigation in this case is already complete and therefore, nothing has been left to be recovered from the possession of petitioner; vi. that the trial is not likely to be concluded in near future; vii. that detention of the petitioner in judicial lockup is not likely to serve any purpose; viii. that there is nothing on record to show that if released on bail, the petitioner may tamper with the evidence or influence the witnesses; and ix. that there is nothing on record to show that if released on bail, the petitioner will not participate/cooperate in the trial. 9.
If the cumulative effect of all the abovementioned factors, involved in the instant case, is taken into consideration, it leads to a GAURAV THAKUR 2026.07.23 09:15 I attest to the accuracy and integrity of this document
