Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than three and half months and there has been no recovery of the present petitioner. Petitioner’s involvement is because of statement of co-accused. Learned advocate appearing for the State opposes the prayer for bail and submits that the petitioner was absconding for a considerable period of time. I have taken into account the conduct of the petitioner and the subject matter of the case which relates to alleged recovery of 6.34 kg. of Codeine phosphate. Having regard to the totality of the circumstances, I direct the learned trial court/special court to release the petitioner on bail after the stage of consideration of charges are over. It has been informed that on 7/8/2026 date has been fixed, if the charges are not framed on 7/8/2026, the

learned trial court within a fortnight from date would conclude the same. With the above observations, CRM (NDPS) 1567 of 2026 is disposed of. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
