Periodical Maintenance to Nellore - Podalakur - Sydapuram Road (SH 053) from KM 28/950 to 29/800 and KM 32/800 to 35/600 in SPSR Nellore District, vide Agreement No. C.R. No. 102/2022-2023, dated 23.01.2023, 3. Urgent Repairs to laying B.T Roads in approaches of meeting place of Sri. Venugopa Swamy Degree College grounds in view of visit of Honble Chief Minister of Andhra Pradesh for Ammavodi Programme in Nellore District on 11.01.2021, vide Agreement No. C.R. No. 104/2021-2022, dated 31.03.2022 and 4. Urgent Repairs to Nellore - Krishnapatnam Road from KM 0/0 to 0/8 in view of the visit of Honble Chief Minister of Andhra Pradesh Ammavodi Programme in Nellore Town on 11.01.2021, vide Agreement No. C.R. No. 105/2021-2022, dated 31.03.2022 duly approved by the respondents, as illegal, arbitrary, unjust, unreasonable and violative of fundamental rights guaranteed to the Petitioner under Articles 14 and 21 of the Constitution of India and consequently direct the respondents to release an amount of Rs. 3, 78,61,674/- towards the works executed by the petitioner along with 12percent interest per annum and to pass. GP FOR FINANCE PLANNING The Court made the following order: Aggrieved by the non-payment of bill amounts to the petitioner in relation to the completed works, the present writ petition is filed. 2. Heard Sri Vinod K.Reddy, learned counsel for the petitioner and Sri Praveen, learned Assistant Government Pleader for Roads & Buildings Department. 3. Learned Assistant Government Pleader on counter submitted that, due to insufficient budget/LOC the bill is unable to upload in the Nidhi Portal and after the receipt of budget/LOC the bill will be generated and submitted to the Assistant Pay & Accounts Officer II WA, Nellore for making payment to the petitioner and accordingly sought six(06) months time for such payment. 4 4. To the said submission, learned counsel for the petitioner reported no objection. 5. Taking into consideration the submissions of both the learned counsel and as the authorities are ready to pay the entitled amount to the petitioner, this court is inclined to dispose of the writ petition, at the admission stage with the following direction. The respondents are directed to release the legally admitted/entitled net amount to at the earliest, and at any rate, within a period of six(06) months from the date of receipt of copy of this order. Accordingly, the writ petition is disposed of. No costs.
