JUSTICE E.S.INDIRESH ORAL ORDER In this writ petition, the petitioners are challenging the order dated 16.09.2014 (Annexure-S) passed by respondent No.2 and order dated 13.07.2016 passed by respondent No.1 (Annexure-T). 2. Sri V Vishwanatha Shetty, learned counsel appearing for the petitioners contended that land in question has been granted in favour of the father-in-law of petitioners, and accordingly, referred to Annexures-A to D1, and contended that, both the respondent-Authorities had committed an error in interfering with the revenue entries made in favour of the petitioners. 3. Per contra, Sri Mahendra Gowda C R, learned counsel for respondent No.5 contended that, respondent No.5 has purchased the land in question as per the registered sale dated 08.02.2012 from one V. Damodar and his sisters, and therefore, contended that, the - 4 - HC-KAR CNR: KAHC010145962016 NC: 2026:KHC:42771 WP No. 62077 of 2016 petitioners have no legal right to claim the land in question. 4. Smt.B P Radha, learned Additional Government Advocate appearing for respondents No.1 to 4, supports the impugned orders. 5. In the light of the submissions made by the learned counsel appearing for the parties and on careful consideration of the writ papers would indicate that, the petitioners have not produced the order of grant made in favour of them. Despite grant register at Annexure-A wherein issued by the respondent No.3 as to the grant made favour of J Narayana Shetty (father in-law of petitioner No.1). 6. In that view of the matter, the respondent No.5 had purchased the schedule property as per the registered sale deed dated 08.02.2012, and therefore, I am of the view that, the mutation has been made based on the - 5 - HC-KAR CNR: KAHC010145962016 NC: 2026:KHC:42771 WP No. 62077 of 2016 registered sale deed, and therefore, it is open for the petitioners to establish their right in the land in question in a manner known to law.
