(ORAL) The petitioner by way of the present writ petition seeks issuance of a writ in the nature of mandamus directing the respondents to release the petitioner's salary with effect from 28.12.2010, along with interest. 2 As per the petitioner, he was appointed as Chowkidar of village Kherki Jatan, Tehsil Naraingarh, District Ambala, vide order dated 28.12.2010 passed by the Tehsildar, Naraingarh. The appointment of the petitioner was challenged by one Randhir Singh. However, the same was upheld vide order dated 16.08.2012. Thereafter, Randhir Singh filed a review petition, which was also dismissed vide order dated 23.07.2019. The petitioner submits that despite having worked continuously since 28.12.2010, he has not been paid his salary. 3 Response was solicited from the respondents. Para Nos. 3 and 6 thereof read as under : “3. That it is submitted that the petitioner Sh. Naib Singh has concealed the facts from this Hon'ble Court and his demand for the release of salary since 2010 is neither appropriate nor legal. Since Petitioner Sh. Naib Singh was appointed at the post of Safai Karmi (Village Sweeper) on dated 07.01.2008 as per the mutual agreement between the petitioner and gram panchayat Kherki Jattan (Annexure-R1) much before his appointment as village Chowkidar on dated 28.12.2010. He is drawing the salary and other benefits for the post of village sweeper since his day of appointment till date (Annexure R-2) because Gram Panchayat Kherki Jattan has been taking his services only as a village sweeper not as a village chowkidar. xxx xxx xxx 6. That Block Development & Panchayat Officer, Naraingarh has filed case no. 17/2026 Appeal/ Misc. in the court of Deputy Commissioner, Ambala for the termination of services of Sh. Naib Singh s/o Sh. Surmukh Singh as village chowkidar. This case is pending for hearing on dated 17.07.2026.” 4 Counsel for the petitioner is not in a position to dispute that the petitioner has been receiving salary for the post of Village Sweeper. 5 In view of thereof, this Court does not find any reason to interfere in the present writ petition. Accordingly, the writ petition is dismissed.
