19.08.2026 Serial no. 621 [G.S.Das] Assistant Registrar (Court) CRM (A) 2625 of 2026 In re : An Application under Section 482 of the BNSS, 2023/under Section 438 of the Cr.P.C. in connection with Nakashipara PS Case No. 402 of 2026 dated 10.05.2026 u/s 85/103(1)/105/3(5) of the BNS. -And- In the matter of : Bijay Mandal @ Mondal & Ors. … Petitioner(s) Mr. Asraf Mandal Mr. Sumanta Das … for the petitioner(s) Mr. Sagar Saha Ms. Nayana Mukhopadhyay … for the State-respondent(s) Learned advocate for the petitioners submits that they have been foisted with a criminal case because of matrimonial dispute and the FIR, even if it is considered as heinous, it points out towards the husband. Learned advocate for the State opposes the prayer for bail and draws the attention of the court to the post mortem report as well as the statement of the witnesses. I have taken into account the role of the present petitioners who are the father-in-law [petitioner no.1], the 2 brothers-in-law [petitioner nos. 2 and 3], sister-in-law [the petitioner no.4]. Having considered the complicity which has been expressed against them, I am of the opinion that the same is distinguishable from the participatory role of the husband who is not before this court. Considering the same, I am of the view that this is a fit case for granting anticipatory bail to the petitioners. Hence, the prayer for anticipatory bail of the petitioners is Allowed. Accordingly, I direct that in the event of arrest, the petitioners [Bijay Mandal @ Mondal, Saltu Mandal@ Mondal and Sanjay Mandal@ Paltu Maldal@ Mondal and Rita Sardar] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner nos.1, 2 and 3 shall meet with the investigating officer of the case within 10 days from date and, on all subsequent dates, as would be fixed by the I.O. for the sake of investigation. The petitioner no.4 would make herself available before the I.O. as and when she would be required by the I.O. 3 Accordingly, CRM (A) 2625 of 2026 is disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. (Tirthankar Ghosh, J.)
