It appears from the record of the writ petition that the writ petitioner is espousing a public cause by raising question regarding construction of water pumping station at Marcus Square Ground within Ward No. 39 of Kolkata Municipal Corporation. The case of the writ petitioner is that Marcus Square falls in the category of Grade-I Heritage in the list of Heritage Buildings of Kolkata Municipal Corporation. 3. Mr. Ghosh, learned Counsel appearing for the municipal authority submitted that the writ petition is at best, a public interest litigation which cannot be taken up by this Court. He further submits that the construction of reservoir is going on. 2 4. At this juncture the learned Counsel for the writ petitioner seeks leave of this Court to withdraw the writ petition in order to enable the writ petitioner to seek appropriate remedy. 5. In the circumstances, the writ petition is dismissed as withdrawn with liberty to file afresh before the appropriate forum in respect of the self- same cause of action. 6.
