JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the proceedings in C.C.No.43832/2025 in Crime No.238/2025 of Beguru Police Station, pending on the file of learned 9th ACJM at Bengaluru, registered for the offences punishable under Sections 126(2), 324(4), 351(3), 352 r/w Section 3(5) of BNS- 2023 and also under Section 4 of Karnataka Prohibition of - 3 - HC-KAR CNR: KAHC010004692026 NC: 2026:KHC:42738 CRL.P No. 117 of 2026 Violence against Medicare personal and damage to property in Medicare Service institutions Act, 2009. 2. Heard Sri. K. Rama Singh, learned counsel appearing for the petitioners, Smt. Rashmi Patel, learned High Court Government Pleader appearing for respondent No.1, Sri Samarth Prakash, learned counsel for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint affidavit. Terms of settlement reads as follows: "JOINT AFFIDAVIT ." I, SRI PRADEEP KUMAR. R, S/o. S.N.Rama Reddy. Aged about 41 years, R/at: No.37, 4th Cross, 2nd Main, Hosapalya, HSR 3rd sector, Bengaluru -560068, Accused No.1/Petitioner No.1, in the above petition, do hereby solemnly affirm and state on oath as follows:- I, SRI. S.N. RAMA REDDY, S/o. Late. Narasa Reddy, Aged about 69 years, R/at: No.37, 4th Cross, 2nd Main, Hosapalya, HSR 3rd sector, Bengaluru -560068 Accused No.2/Petitioner No.2 in the above petition, do hereby solemnly affirm and state on oath as follows:- I, SRI. SATISH KUMAR.S, S/o. Shreekantappa, Aged about:53 years, Managing Director, Jayashree Multi Speciality Hospital, R/at. No.1104, Mantri PSK Inyakar Apt., Cave Temple, Hulimavu, Bengaluru-560076, the de - 4 - HC-KAR CNR: KAHC010004692026 NC: 2026:KHC:42738 CRL.P No. 117 of 2026 facto complainant (Respondent No. 2/CW-1) above petition, do hereby solemnly affirm and state on oath as follows :- 1. We state that, a complaint came to be registered in Crime No. 238/2025 and the respondent police have Investigated the matter and filed the charge sheet against the Petitioners for the offences Punishable U/S 126(2), 324(4), 351(3), 352 R/w Section 3(5) of BNS-2023 and also U/S 4 of Karnataka Prohibition of violence against Medicare personnel and damage to property in Medicare service institutions act 2009 and the same is pending in CC No. 43832/2025 before the Hon'ble IX ACJM, at Bengaluru. 2. We state that, on the account of some misunderstanding a complaint came to be registered against the petitioners herein and all offences are bailable in nature. 3. We state that, on the advice of elders, well wishers we do not want to prosecute the criminal case as we have amicably settled the dispute out of the court and in order to maintain cordial relationship and harmony we do not want to prosecute the criminal case in CC No. 43832/2025 before the Hon'ble IX ACJM, at Bengaluru. And also the petitioners have also filed a Private complaint in PCR NO. 396/2026 pending before Learned 9th ACJM at Bangalore and undertaken to withdraw the same. 4. We state that, the aforesaid compromise entered into between us has been made voluntarily, of our own free will and consent, without any coercion, undue influence, threat, or pressure from any that we have entered into the same with full understanding of its terms and consequences. WHEREFORE, it is prayed that this Hon'ble court be pleased to permit the parties to compound the case in CC No. 43832/2025 for the offences Punishable under section 126(2), 324(4), 351(3), 352 R/w Section 3(5) of BNS- 2023 and also U/S 4 of Karnataka Prohibition of violence against Medicare personnel and damage to property in Medicare service institutions act 2009 in connection to Crime No.238/2025 and pending before Hon'ble IX ACJM, - 5 - HC-KAR CNR: KAHC010004692026 NC: 2026:KHC:42738 CRL.P No. 117 of 2026 at Bengaluru and consequently quash the entire criminal proceedings in so far as the petitioners in the interest of Justice and equity." 4. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 5. For the aforesaid reasons, the following: ORDER (i) Criminal Petition stands disposed. (ii) Proceedings pending in C.C.No.43832/2025 in Crime No.238/2025 of Beguru Police Station, on the file of IX ACJM, at Bengaluru against the petitioners stands quashed.
