Serial No.13 Regular Cause List HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CCP(S) 451/2025 In WP(C) 1751/2025 KAMAL KRISHEN KAUL AND ORS …PETITIONER(S) Through: Mr. Z. A. Wani, Advocate with Mr. M. A. Wani, Advocate. V/s. ATAL DULLO AND ORS ...RESPONDENT(S) Through: Mr. Mohsin S. Qadri, Sr. AAG with Mr. Haris Khan, Advocate. CORAM: Hon’ble Mr. Justice Wasim Sadiq Nargal, Judge. ORDER 25.09.2026 01. The instant contempt petition arises out of an order/judgment passed by the learned writ Court on 25.07.2025 in WP(C) No. 1751/2025, by virtue of which the writ petition preferred by the petitioners was disposed of at the very threshold with the consent of the learned counsel for the parties, by directing the respondents to treat the writ petition as representation and take a decision thereon strictly under rules and in accordance with law within a period of six weeks from the date a copy of the said Order along with writ petition and enclosed annexures, was made available to the respondents. 02. Since the aforesaid order was not complied with, the instant contempt petition has been preferred by the petitioners, in which notice was issued on 29.12.2025. 03. The record reveals that the compliance report stands filed on behalf of the respondents on 09.04.2026, in which the respondents have taken a specific stand that the order passed by the learned writ Court stands complied with. 04. The respondents while filing the compliance report, have also placed on record the detailed consideration order dated 28.08.2025 bearing No. 249-RRCM of 2025, by virtue of which, the case of the petitioners was considered in due deference to the directions passed by this Court on 25.07.2025 and was found devoid of any merit and the same stood rejected. 05. Since the order passed by the learned writ Court, which is the subject matter of the instant contempt petition, was only to the extent of directing the respondents to consider the representation of the petitioners and to take a decision strictly under rules and in accordance with law, which order has been complied with and the detailed consideration order has also been placed on record along with the compliance report, therefore, this Court is of the view that the order stands complied with and no contempt is made out. 06. Accordingly, proceedings in the instant contempt petition are closed. Rule, if any, shall stand discharged. 07. However, it is made clear that closure of the contempt petition shall not come in the way of the petitioners to challenge the consideration order mentioned supra, by way of appropriate proceedings, if so advised.
