Kausik (Allowed) CRM (NDPS) 1707 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Mothabari Police Station Case No. 09 of 2026 dated 24.06.2026 under Section 21(C)/25/27A/29 of the NDPS Act, 1985. And In the matter of : Samaun Sk. @ Dallu Sk. & Anr. ……Petitioners. Mr. Amit Ranjan Pati Mr. Avijit Chatterjee Ms. Swastika Chowdhury Ms. Ilika Nag ……for the Petitioners. Mr. Rajendra Banerjee, Ld. APP Mr. Debajyoti Adhikari ……for the State. Learned advocate appearing for the petitioners submits that petitioners are in custody for about 6 months and the total recovery in the present case is 75 bottles of Eskuf Cough Syrup, although there has been no recovery from the present petitioners and the present petitioners have been implicated on the basis of statement of co-accused. Learned advocate for the State opposes the prayer for bail but is unable to refute the contention that there was no recovery from the present petitioner. Having considered the complicity of the present petitioner, I am inclined to allow their prayer for bail. 2 As such, prayer for bail of the petitioners is allowed. Accordingly, Petitioners, namely, (1) Samaun Sk. @ Dallu Sk., (2) Mohammad Ali @ Royal @ Mahammad Ali @ Rayat shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 1707 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
