This appeal was filed by the appellant/Insurance Company challenging the order dated 6th May, 2011 passed by the Learned Judge Workmen’s Compensation, 1st Court, West Bengal in Claim Case No. 131 of 2007. It is submitted by the learned advocates that during pendency of this case parties have decided to resolve the dispute amicably. It is further submitted by the learned advocates that the parties have entered into one time settlement that the appellant/National Insurance Company shall pay to the respondent/claimant of Rs.3,38,000/- as full and final satisfaction of the claim. In the facts and circumstances, nothing remains to be decided in the said appeal, thus the appeal being FMAT 7 of 2017 stands disposed of as being settled. The appellant/National Insurance Company will deposit the compensation cheque before the Registrar General, High Court, Calcutta within eight weeks from the date of communication of this order. The respondent/claimant will be entitled to withdraw the compensation amount upon compliance of necessary formalities. Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings. (Biswaroop Chowdhury, J.) 2
