2. Mr. J.P. Kandpal, learned AGA, for the State of Uttarakhand.

In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Ankit, who has been accused in FIR/Case Crime No.52 of 2025, dated 18.02.2025 under Sections 137 (2), 64 (2)(m), 65 (1), 64 (2) (f) and 87 of the Bharatiya Nyaya Sanhita, 2023 and under Sections 3 (a)/4(ii) and 5 (1)(n)(j)(ii)/6 of the Protection of Children from Sexual Offences Act, 2012, at Police Station Kotwali Gangnahar, District Haridwar.

As per the prosecution story on 18.02.2025, the First Information Report has been lodged by the Complainant against the present Applicant and other co-accused persons alleging that on 08.02.2025, at about 12:00 noon, the minor daughter of the informant was allegedly enticed away by the Applicant along with other named co-accused person.

Learned counsel for the Applicant submits that the Applicant has falsely been implicated in the present matter and the Applicant is languishing in jail since 19.02.2025. He further submits that Applicant neither enticed nor forcibly
took the prosecutrix with him, nor did he commit any sexual assault upon her. It is further contended that prosecutrix voluntarily stayed with the Applicant and their marriage was solemnized on 19.02.2025. The prosecutrix in her statements recorded under Sections 180 and 183 of BNSS, wherein, she clearly admitted that there was a love relationship between her and the Applicant.
6. Learned State Counsel has vehemently opposed the bail application of the Applicant with the contention that the victim is a minor and as per record of the school, her date of birth is 16.04.2009.
7. Considering the overall facts and circumstances of the case and the fact that the Victim is a minor, Applicant has not made out a case for bail.
8. Accordingly, the bail application is hereby rejected.
