The application is filed seeking following reliefs: a) To Direct the respondent 1 to pay a sum of Rs.4,94,063/- and Rs.5,83,779/- as interest @ 18% from 07.02.2017 to 31.08.2023, total amounting Rs.10,77,842/- and future interest from 01.09.2023 till the date of payment. and b) To pass such other order or orders as this Hon'ble Court deem fit and proper in the facts and circumstances of the case. 3. Counsel for the respective parties urged several contentions. 4. Counsel for respondent No.1 on instructions submits that an appropriate order may be passed regarding payment of interest. 5. Counsel appearing for the Official Liquidator, on instructions, submitted that an appropriate order may be passed, leaving the matter to the discretion of this Court. 6. Taking note of the submissions made by the respective parties, respondent No.1 is directed to pay a sum of - 4 - HC-KAR CNR: KAHC010552442023 NC: 2026:KHC:43092 CA No. 298 of 2023 In COP No.57 of 2012 and others Rs.2,00,000/- towards interest to the Official Liquidator within a period of four weeks from today, without fail and without compelling the Official Liquidator to initiate execution proceedings. 7. Counsel for respondent No.1 submits that the principal amount of Rs.4,94,063/- has been paid today by handing over Cheque No.100453 to the Official Liquidator in the open court. The Official Liquidator acknowledges receipt of the said cheque in the open court. 8. Accordingly, the Company Application stands disposed of.
