Brief facts of the case of the prosecution are that the Applicant, along with co-accused Rajveer Singh, Jasdev Singh @ Jassu Kang, Nagpal, Raj Bareth, Arjun Patel, Mahfool Ahmed and Soni @ Srijan Pandey, formed an unlawful assembly on 07.12.2024 behind the Post Office, in front of a gym at Raigarh, while armed with sharp-edged weapons, iron rods and sticks. It is alleged that they abused Sahil Thakur, Aman Singh, Aqib Khan and Sangam Dahri in filthy language and threatened them with dire consequences. It is further alleged that Sahil Thakur was assaulted with an iron rod and stick, causing him grievous injuries, while Aman Singh was assaulted with an iron rod, causing him voluntarily hurt. On the basis of the report lodged by the complainant, FIR was registered at Police Station City Kotwali, Raigarh, and the accused persons were arrested. After completion of investigation, the charge-sheet was filed against the arrested accused persons, while the Applicant and co-accused Sandeep Singh @ Sunny Sardar were shown as absconding. Based on the aforesaid allegations, the police registered the offences as mentioned above against the present Applicant.

Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is contended that five co-accused persons were charge-sheeted and faced trial, whereas the Applicant was shown as absconding. It is further submitted that three co- accused persons have already been convicted and have undergone their sentences and that the injured has filed an affidavit stating that the Applicant was not the person who assaulted him. He lastly submits that the Applicant is in custody since 11.06.2026 and the trial is likely to take considerable time for its conclusion, therefore, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application.

Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature of the allegations and the fact that the Applicant remained absconding and was arrested only on 11.06.2026, whereas the trial of the other co-accused had already proceeded and culminated in their conviction, this Court is of the considered opinion that the Applicant cannot claim parity with the co-accused who had faced trial and were convicted.
4 Thus, this Court is not inclined to grant bail to the Applicant.
6. Accordingly, the bail application of the Applicant – Sandeep Singh @ Sinni Sardar involved in Crime No.741/2024 registered at Police Station – City Kotwali, Raigarh (C.G.), for the offences under Sections 296, 351(3), 115(2), 109, 191(2), 191(3) and 118(2) of BNS is hereby rejected.
7. However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial expeditiously, preferably within a period of six months from the date of receipt of copy of this order in accordance with law, if there is no legal impediment.
