This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for direction upon the learned Civil Judge (Senior Division), 3rd Court at Barasat, to dispose of the Title Suit no. 920 of 2024, expeditiously. The learned advocate appearing for the petitioner submits that the written statement has not yet been filed and prayer for extension of time to file the written statement was made on several occasions. From the order sheets appended to this application, this Court finds that an application for injunction is still pending and 30th November,2026 has been fixed for hearing of the injunction application. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Senior Division), 3rd Court, at Barasat, to take up the hearing
2 of the injunction application on the next date fixed, if the same is otherwise ready for hearing, and dispose of the same as expeditiously as possible preferably within a period of 12 weeks from the date of next date fixed without granting any unnecessary adjournments to either of the parties. After disposal of the injunction application as well as any other interlocutory application that may be pending, the learned trial judge shall make an endeavour to dispose of the Title Suit Nos. 920 of 2024 as expeditiously as possible, without granting any unnecessary adjournments to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
