D/L- 35 18/08/2026 Ct. No.- 6 Aritra C.O. 2764 of 2026 Mansur Ali Khan & Ors. Vs. Aminuddin Khan & Ors. This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Div.), 7th Court at Alipore to dispose of the Title Suit No.21005 of 2012 expeditiously. From the order sheets appended to this application this Court finds that an application for injunction is pending and the ad interim order of injunction has been extended till September 9, 2026. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. CO 2764 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 7th Court at Alipore to take up the hearing of the injunction application, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After disposal of the injunction application, if the 2 suit is otherwise ready for hearing, the learned trial judge shall make an endeavour to dispose of Title Suit No.21005 of 2012 as expeditiously as possible without granting any unnecessary adjournments to either of the parties keeping in mind that the suit is pending from the year 2012.
