3. The present criminal misc. application has been filed with a prayer to direct the learned Additional Principal Judge, Family Court, Kotdwar, District Pauri Garhwal to decide the Misc. Criminal Case No. 06 of 2023, Tarendra Rauthan Vs. Rashmi Rauthan, in an expeditious manner.
4. In the present case, applicant filed an application under Section 340 of Cr.P.C. before the court of learned Additional Principal Judge, Family Court, Kotdwar, District Pauri Garhwal, wherein, it was submitted that respondent/wife have submitted the forged documents in support of her affidavit filed in the proceedings under Section 27 of Hindu Marriage Act (Matrimonial Case No. 04 of 2018).
5. Applicant has also enclosed the entire ordersheet of the matter and perusal of the ordersheet reveals that respondent has put in her appearance before the court on 20.11.2024, but, thereafter, she has sought adjournments each and every day.
6. Learned counsel for the applicant would submit that even after a lapse of one year, his application has yet not been decided.
7. Heard learned counsel for the parties and perused the record.
8. This Court, after hearing the parties and considering all the documents on record, thinks it proper and appropriate and directs the court of learned Additional Principal Judge, Family Court,
Kotdwar, District Pauri Garhwal to decide the Misc. Criminal Case No. 06 of 2023, Tarendra Rauthan Vs. Rashmi Rauthan, after hearing both the parties and without giving unnecessary adjournment to any of the parties, as expeditiously as possible, preferably within a period of three months from the date of production of certified copy of this order.
9. With the above observation, the present criminal misc. application stands disposed of.
