Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner is apprehending his arrest in connection with Koderma (Mahila) P.S. Case No. 41 of 2025, registered for the offence under Sections 85, 115(2), 351(2), 352/3(5) of Bhartiya Nyaya Sanhita, 2023 and Section 3/4 of the Dowry Prohibition Act pending in the court of learned S.D.J.M., Koderma.

Learned counsel appearing for the petitioner submits that the petitioner happens to be the husband of the informant and there are general and omnibus allegations of torture and demand of dowry against all the family members. He further submits that other family members have been granted anticipatory bail by the learned Sessions Judge. He also submits that the petitioner was in Army and due to the behavior of the informant, he has been forced to leave the Army and in spite of that when the situation did not improve, the petitioner was compelled to file divorce suit being Original Suit No.147 of 2025 on 03.11.2025 and thereafter, the present case has been lodged on 06.12.2025.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner happens to the husband.

Considering that the petitioner has filed divorce suit being Original Suit No.147 of 2025 on 03.11.2025 and thereafter, the present case has been lodged on 06.12.2025 and other family members of the family have been granted anticipatory bail by the learned Sessions Judge, and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
