Accused in Crime No.177/2026 registered by Chamarajanagar Town Police Station, Chamarajanagar, for the offences punishable under Sections 85, 115(2), 352, 109(1) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.177/2026 was registered by Chamarajanagar Police Station, Chamarajanagar, for the aforesaid offences against the petitioner based on the first information dated 29.06.2026 received from Kubra Tabsum who is the wife of the petitioner. In the said case, petitioner was arrested on 29.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.268/2026 was rejected on 07.07.2026. Therefore, petitioner is before this Court. 4. Perusal of the material on record would go to show that marriage of the petitioner with the alleged victim was - 3 - HC-KAR CNR: KAHC010471962026 NC: 2026:KHC:42357 CRL.P No. 10132 of 2026 solemnized on 05.06.2022 and the said marriage was an arranged marriage. The allegation against the petitioner is that after the victim had delivered a boy baby, petitioner had developed intimacy with another lady, and therefore, there was quarrel between the couple regularly. On 28.06.2026 at about 7.00 a.m., the victim picked the mobile phone of the petitioner and came to know that the petitioner had sent money to another lady. Thereafter, she had inquired about the same with the petitioner, and therefore, there was a quarrel between them and petitioner allegedly tried to strangulate the neck of his wife and tried to commit her murder. When she started shouting, nobody came to her rescue, and therefore, she threatened the petitioner and attempted to drink harpic. The petitioner, thereafter, made her to drink harpic. Subsequently, the petitioner and his mother took her to a hospital for treatment and admitted her in the said hospital. 5. Petitioner is in custody in the present case from 29.06.2026. Undisputedly, the victim girl has not suffered any injury in the incident in question and the allegation against the petitioner is that he had strangulated her with his hands and - 4 - HC-KAR CNR: KAHC010471962026 NC: 2026:KHC:42357 CRL.P No. 10132 of 2026 made her to drink harpic. However, the fact remains that immediately after the victim had consumed harpic, it was the petitioner and his mother who had shifted her to the hospital for her treatment. 6. Considering the aforesaid aspects of the matter and since major portion of the investigation is already completed, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 7. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.177/2026 registered by Chamarajanagar Town Police Station, Chamarajanagar, for the offences punishable under Sections 85, 115(2), 352), 109(1) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the - 5 - HC-KAR CNR: KAHC010471962026 NC: 2026:KHC:42357 CRL.P No. 10132 of 2026 Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
