1. Learned Advocate for the petitioner submits that the petitioner has been implicated in this case out of personal grudge. He submits that a dispute cropped up between the petitioner and the de facto complainant, which is civil in nature. However, the same has been given a criminal colour. He submits that the petitioner be granted anticipatory bail.
2. Learned Advocate for the State produces the case diary and opposes the prayer for anticipatory bail. He submits that the petitioner is an influential person, being the husband of a political leader, and that, since 2023, he alongwith his associates had, in various ways, been trying to extort money from the complainant and has inflicted various forms of mental and emotional torture upon him.
3. Heard the learned Advocates appearing for the respective parties and perused the materials on record. Having considered the materials in the case diary, the nature of the offence, and the fact
2 that incidents allegedly occurred in presence of direct evidence, I am of the view that the benefit under Section 482 of the BNSS can be extended in favour of the petitioner, subject to certain conditions.
4. Accordingly, I direct that, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned ACJM Barrackpore and also subject to the conditions as laid down under Section 482(2) of the BNSS, 2023. Petitioner shall meet the investigating officer once in a week till submission of chare sheet.
5. The application being CRM (A) 2132 of 2026 is disposed of.
