Brief facts of the case of the prosecution are that the complainant lodged a written complaint alleging that the Applicant induced her by promising to marry her and to secure her employment as an operator at AIIMS Hospital, Raipur, and demanded Rs.6,00,000/- for the same. It is further alleged that on the pretext of securing her employment and marrying her, the Applicant took her to a hotel at Tatibandh and established physical relations with her. Thereafter, on different occasions, he allegedly obtained a total amount of Rs.4,50,000/- from her in the name of securing the said employment and cheated her. During investigation, it was further revealed that the Applicant had prepared and issued a forged appointment order purportedly showing the complainant's appointment at AIIMS Hospital, Raipur, and documents regarding online transfer of money by the complainant to the Applicant were also collected. Based on the aforesaid allegations, the police registered the offences as mentioned above against the present Applicant. Hence, this application.

Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present
3 case. It is contended that the victim had been in a relationship with the Applicant since April, 2025 and had given him an amount of Rs.6,00,000/- for investment in the share market. It is further submitted that when the relationship did not materialize, the victim lodged the FIR against the Applicant by alleging that the amount was taken from her on the pretext of securing employment. He further submits that there is considerable delay in lodging the FIR, the Applicant is in custody since 14.02.2026 and the trial is likely to take considerable time for its conclusion, therefore, he may be enlarged on bail.

Per contra, learned State Counsel opposes the bail application and submits that the victim had transferred substantial amounts to the Applicant through multiple transactions, including PhonePe and bank transfers. It is further submitted that her statement recorded under Section 183 of the BNSS reveals that the Applicant obtained Rs.1,50,000/- and Rs.4,50,000/- from her on the pretext of securing employment and thereafter established physical relations with her on the false promise of marriage. It is thus submitted that the allegations are serious in nature and the Applicant is not entitled to the benefit of bail.
5. Considering the submissions advanced by learned Counsel
4 for the parties, the material available in the case diary, the nature and gravity of the allegations, the statement of the victim recorded under Section 183 of the BNSS, which prima facie indicates that the Applicant exploited the victim on the pretext of securing employment and marriage and obtained substantial amounts of money from her, including Rs.1,50,000/- and Rs.4,50,000/- through bank transactions and the fact that a forged appointment order was allegedly prepared in her name, this Court is of the considered opinion that the Applicant does not deserve the benefit of bail.
6. Accordingly, the bail application of the applicant – Ritesh Chandrakar involved in Crime No.45/2026 registered at Police Station – Amanaka, Raipur, Distrcit Raipur (C.G.), for the offences under Sections 69, 318(4), 336(3), 338 and 340(2) of BNS is hereby rejected.
