Petitioner is in custody for 4 years 9 months and it is submitted that out of 21 witnesses, 16 witnesses have been examined.
Having regard to the merits of the case, a last opportunity is granted to the prosecution to complete rest of the witnesses within a period of 3 months from the next date fixed.
Learned Trial Court would, if in spite of best of the efforts and co-operation extended by the petitioner, is unable to complete the prosecution witnesses, on an application for bail, will leniently consider the same. No unnecessary adjournment
2 be granted to any of the parties and the trial of the case would continue in spite of any resolution of the local bar.
At this stage, the prayer for bail of the petitioner is rejected.
Learned Trial Court would abide by the directions passed above.
With the aforesaid observations CRM (M) 890 of 2026 is disposed of.
