1. Learned advocate appearing for the petitioners submits that the petitioners have been falsely implicated in this case out of previous grudge. The de facto complainant and the petitioners are neighbours. 2. State is represented. 3. I have gone through the materials in the case diary including the statements of the witnesses as well as the injury report. The injury report demonstrates that small scratch mark with 4 cm in length was found over the forearm of the victim. There was a cut injury over left parieto temporal region. Such injuries have been classified as grievous. 2
4. However, from the materials in the case diary, it appears that there was an altercation between the de facto complainant and the accused persons over the issue of property disputes. The principal accused who is said to have inflicted blow upon the victim has already been granted bail by the jurisdictional Court. No specific overact has been attributed to these petitioners except the omnibus allegations. 5. In such circumstances, considering the materials in the case diary, the petitioners being the lady, their prayer for anticipatory bail is allowed. 6.
Accordingly, I direct that in the event of arrest the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioners shall cooperate with the investigations till its completion and on further condition that the petitioners shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioners in Court including cancelling the anticipatory bail granted without further reference to this Court. 7.
