And In Re : Md. Tabarak @ Tabarak @ Md. Tabarrak ... Petitioner. Mr. Kazi M. Rahman ... For the Petitioner. Mr. Kallol Mondal, Ld. PP, Mr. Koustav Lal Mukherjee, Mr. Abhijit Singh ... For the State. Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 25 bottles of Phensedyl and petitioner is in custody for more than two months. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and produces the case diary. Records of the case reflect that petitioner is similarly placed as other accused person viz. Sk. Manirul Islam who has been granted bail on 08.07.2026 in CRM(NDPS) 1480 of 2026. I have taken into account the materials appearing in the case diary and having considered the same, I am of the opinion that the present petitioner viz., Md. Tabarak @ Tabarak @ Md. Tabarrak be released on bail by the learned 2 Special Court on the same terms and conditions as the other accused person who has been granted bail in CRM (NDPS) 1480 of 2026. Accordingly, the prayer for bail of the petitioner is allowed. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1724 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
