ORAL ORDER
(PER: HON'BLE MR. JUSTICE D K SINGH)
The only question which is involved in this petition is that whether the order of compulsory retirement would relate back to the order of dismissal passed by the management or it would take effect from the date of the
order passed by the Central Government Industrial Tribunal.
2. In view of the settled position of law, that the
order of compulsory retirement would take effect from the
order of dismissal by the management, the late petitioner has been paid full pension since the order of termination till his death and thereafter the family pension is paid.
3. Sri. T.P. Muthanna, learned counsel for the respondent - Bank has filed a memo showing the arrears of pension paid to the late Chandrakanta, the workman from 16.01.1998 that is the order of dismissal till he died

on 01.05.2018 and thereafter the family pension has been paid.
In view of the aforesaid factual position nothing survives in this Writ Petition which is being dismissed as having become infructuous.
