(ORAL) Prayer in the present petition preferred under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is for setting aside of the order dated 13.01.2026 (Annexure P-4) passed by the Court of Additional Sessions Judge, Fatehabad, whereby bail granted to the petitioner was cancelled; the bail bonds were forfeited and the presence of the petitioner was ordered to be secured by way of arrest warrants. 2. Learned counsel for the petitioner submits that the appeal preferred against the judgment of conviction dated 06.01.2024 and order of sentence dated 10.01.2024 passed by the trial Court, was admitted by the Appellate Court on 09.02.2024 and the sentence of the petitioner was suspended. It is further submitted that since then the appellant had been regularly appearing before the Appellate Court. Learned counsel submits that the absence of the appellant on 13.01.2026 was due to the miscommunication of the date of hearing given by his counsel. It is further submitted that the petitioner is ready to appear before the Appellate Court, but as the presence of the petitioner is ordered to be secured through arrest MANI KUMAR 2026.07.22 18:37 I attest to the accuracy and integrity of this document CRM-M-36829-2026 (O&M) -2- warrants, he apprehends that the moment he appears, he shall be arrested. Learned counsel submits that the petitioner shall continue to appear before the Appellate Court regularly and shall not absent himself from the proceedings. 3. Notice of motion. 4. Mr. Amit Sahni, Addl. A.G., Haryana, accepts notice on behalf of the respondent-State. Learned State counsel opposes the prayer made by the petitioner stating that the petitioner did not appear before the Appellate Court on 13.01.2026 and has been on the run since then. 5. I have considered the submissions made by learned counsel for the parties. 6. No doubt, the petitioner did not appear before the Appellate Court on 13.01.2026 as a result of which, his bail was cancelled. However, the reason given for not appearing before the Appellate Court on 13.01.2026 is found to be genuine and the explanation is accepted. 7. Accordingly, the present petition is disposed of with a direction that in case the petitioner surrenders before the Appellate Court within one week from today and files an application for bail, the same be decided expeditiously in accordance with law. 8. Till the application for bail is decided by the Appellate Court, the petitioner shall not be arrested. Pending application(s), if any, shall also stand disposed of.
