By virtue of the present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioners seek quashing of FIR No.0038/2025 dated 27.06.2025 registered at PS.: Cyber Police Station, North Delhi under Section 318 (4) of the Bharatiya Nyaya Sanhita, 2023 (BNS) and all proceedings emanating therefrom, in view of the latest Memorandum of Understanding dated 16.01.2026, arrived at between the petitioners and the respondent no.2, which is accompanied by their respective proofs of identities. 2. At the outset, learned counsel for the petitioners submits that a fresh Memorandum of Understanding dated 16.01.2026 (MoU) inter se the private parties has since been filed pursuant to the last order, however, the same is not on record. In any event, original thereof, has been handed over This is a digitally signed order. Learned ASC for the State accepts notice, and submits that he has no objection to the quashing of the aforesaid FIR. 5. Respondent no.2, who was present in Court on 12.01.2026, also accepted notice and affirmed the terms of the aforesaid MoU, whereby the petitioners have already paid her a sum of Rs.1,25,000/- as full and final settlement of all claims, disputes and grievance arising out of the aforesaid FIR and have no objection to the quashing of the present FIR. 6. The petitioners and the respondent no.2, who were present in Court on 12.01.2026, as well as their credentials, as on record, had been identified by the Investigating Officer. 7. Even though the nature of the allegations and the FIR is such, however, it is to be noted that a Settlement has already been arrived at voluntarily between the parties, qua which they have also filed accompanying affidavit(s) herein, and also that the parties shall remain bound by all the terms and conditions thereof. As such, following the law laid down by the Hon9ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr. (2013) 4 SCC 58, Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466, continuation of the present FIR against the petitioners will be an exercise in futility. 8. Accordingly, the present petition is allowed and FIR No.0038/2025 dated 27.06.2025 registered at PS.: Cyber Police Station, North Delhi under Section 318 (4) of BNS and all proceedings emanating therefrom are hereby quashed.
