Learned advocate appearing for the petitioner submits that there was a gross-violation of the proceedings of arrest and subsequent production before the jurisdictional Court. Petitioner is in custody for more than one year three months and there has been no progress in the case. On the other hand learned advocate appearing for the NCB submits report. It has been contended that the vehicle from where recovery was effected belong to the wife of the present petitioner and seizure in the present case is 82.20 kgs of ganja. Having considered the quantum of contraband seized, I am of the opinion that rigors of Section 37 of the NDPS Act is attracted. As such prayer for bail of the petitioner in CRM (NDPS) 1666 of 2026 is rejected.
2 Learned trial Court would expedite the process of trial and commenced the witness action at the earliest. Report submitted by the NCB be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
