……Petitioner.
Mr. Swapan Banerjee
Mr. Debapratim Guha
Mr. Kunal Ganguly
Mr. Diptendu Banerjee
Mr. Subhodip Maity
……for the Petitioner.
Mr. Pinaki Bhattacharyya, Sr. Govt. Adv.
Mr. Amartya Mohan Bhattacharyya
….for the State.
Learned advocate appearing for the petitioner submits that petitioner was not named in the FIR and his name appeared in the charge sheet.
Learned advocate for the State has produced the case diary.
I find that the FIR reflects that the face of three persons were covered and it was these three persons who inflicted vital blow on the deceased resulting in his death.
2
Having considered the gruesome manner in which the victim was assaulted to death, I am not inclined to give the benefit of anticipatory bail to the petitioner as he had been evading the process of law.
Accordingly, CRM (A) 1863 of 2026 is dismissed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
