This is the Second bail application :led under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 138/2025 registered at Police Station – Torwa, District – Bilaspur (C.G.), for the o>ence punishable under Sections 64(1), 70(1), 351(2), 115(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023. 2. The case of the prosecution, in brief, is that on 31.03.2025, at about 7:00 p.m., the applicant, Raj Rishi Singh, allegedly called the victim and invited her to his house on the pretext of discussing a marriage proposal and introducing her to his father, uncle Surendra Kumar Singh, and aunt. Believing the said representation, the victim left to meet the applicant. It is alleged that the applicant picked her up on the way near Bandhwapara Talab and took her to his house for the said purpose. It is further alleged that, upon reaching the house, the applicant’s uncle, Surendra Kumar Singh, was already present there. As soon as they entered the house, the applicant allegedly closed the door. When the victim started shouting, the applicant allegedly gagged her by pressing her mouth and strangled her. The victim further alleged that the applicant was under the inDuence of alcohol and threatened her by saying that if she raised an alarm, they would kill her and dispose of her body, and that she would not be allowed to leave. Thereafter, the applicant and his uncle allegedly committed forcible sexual intercourse with the victim, one after the other, without her consent. It is further alleged that, upon hearing her cries, nearby persons arrived at the spot and rescued the victim. Thereafter, on the basis of her complaint, the aforesaid o>ence was registered as Crime No. 138/2025 at Police Station Torwa against the applicant and his uncle, Surendra Kumar Singh. 4. The learned counsel for the applicant submits that the :rst bail application of the applicant was rejected by this Court on merits.
The second bail application of the applicant is being preferred on the grounds that the co-accused, namely, Surendra Kumar Singh, has already been enlarged on bail by this Court in MCRC No. 5096 of 2025 vide order dated 02.07.2025. Therefore, the present applicant is also entitled to be enlarged on bail on the ground of parity. He submits that the charge-
3 sheet was :led on 10.05.2025 and charges were framed on 21.07.2025. The case was :xed for recording the evidence of the victim on 18.08.2025, however, she did not appear before the learned trial Court. Thereafter, the victim was summoned and even a bailable warrant of Rs. 500/- was issued against her, however, she has not appeared before the learned trial Court till date for recording her evidence. Consequently, the trial has been delayed and not a single prosecution witness has been examined so far. He submits that the applicant has no criminal antecedents and he is in jail since 02.04.2025, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 5. On the other hand, the learned State counsel opposes the bail application of the applicant and submits that the :rst bail application of the applicant was rejected on merits by this Court against which the applicant preferred an SLP (Crl.) No. 55181 of 2025 before the Hon’ble Supreme Court which was also dismissed vide order dated 25.02.2026. She further submits that the applicant is the principal accused and there are speci:c allegations against him of committing forcible sexual intercourse with the victim. Considering the nature and gravity of the allegations and the material available on record, she submits that the applicant is not entitled to the grant of regular bail. 6. I have heard learned counsel for the parties and perused the case diary. 7.
Considering the facts and circumstances of the case, the nature and gravity of the allegations, the material available on record, the speci:c allegations against the applicant of committing forcible sexual intercourse with the victim, and further taking into consideration the fact that the :rst bail application of the applicant was rejected on merits by this Court against which the applicant preferred an SLP (Crl.) No. 55181 of 2025
4 before the Hon’ble Supreme Court which was also dismissed vide order dated 25.02.2026, therefore, this Court is not inclined to enlarge the applicant on bail. 8. Accordingly, the Second bail application of the applicant – Raj Rishi Singh, involved in Crime No. 138/2025 registered at Police Station – Torwa, District – Bilaspur (C.G.), for the o>ence punishable under Sections 64(1), 70(1), 351(2), 115(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 9. However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial as expeditiously as possible within a period of six months from the receipt of a certi:ed copy of this
order in accordance with law, if there is no legal impediment.
10. O5ce is directed to send a certi:ed copy of this order to the trial Court concerned for necessary information and compliance forthwith.
