The petitioner is apprehending his arrest in connection with Pakur (Town) Malpahari (O.P.) P.S. Case No. 104 of 2025, registered for the offence under Sections 137(2), 96, 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned S.D.J.M., Pakur. 3. Learned counsel appearing for the petitioner submits that the petitioner’s father and informant are brother and after death of father of the petitioner, his family members shifted to West Bengal for earning their livelihood. She submits that the present case has been lodged with intention to grab the ancestral property of the petitioner and the petitioner happens to be aged about 20 years. She also submits that one of the co-accused has been granted anticipatory bail in A.B.P. No.292 of 2025 by the learned Sessions Judge and another has been granted regular bail. She also submits that the petitioner is having no criminal antecedent. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that in the statement recorded under Section 183 of the BNSS, the victim has taken the name of this petitioner along with the others. 5. Considering that one of the co-accused has been granted anticipatory bail and that the informant is uncle of this petitioner, in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
