Affidavit of service filed by the petitioner is taken on record. The petitioner who is the Sahakari Sabhapati of Hasnabad Panchayat Samiti has assailed the no confidence motion submitted by the private respondents/members of the Samiti for his removal on the ground that the copy of the notice has been sent to a residential address which is not his. The notice of meeting was served by the Sub- Divisional Officer, Basirhat Sub-Division at his correct address. Opposing such allegation, learned counsel for the private respondents produces documents which demonstrate that copy of the notice was sent to the address of the petitioner at Village & Post Murarishaw, PS. Hasnabad, District North 24 Parganas and delivered to the addressee. 2 Learned counsel submits that the petitioner owns 4 houses and the addresses to which the motion and notice of meeting were sent are both correct. In view of the fact that copy of the motion was served at the office of the petitioner as well as at his residential address in compliance with Section 101(2) West Bengal Panchayat Act, 1973, it can be held that the motion or the notice does not suffer from any illegality/irregularity. Since the meeting has been fixed on 25th August, 2026, the Officer in Charge, Hasnabad Police Station is directed to render necessary assistance to the Prescribed Authority so that the meeting is held peacefully and without any hindrance from any corner whatsoever. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. The parties are at liberty to communicate the gist of the order to the concerned authorities at the earliest. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
