Learned advocate appearing for the petitioners submits that he is not pressing the application for petitioner nos. 1 to 5 namely, Hare Krishna Barman; Barun Barman @ Barun Chandra Barman; Hiren Barman @ Hiren Chandra Barman; Janak Barman and Bhim Chandra Das @ Bikram Das. Report of the State reflects that Sabitri Barman was arrested on 21.11.2025. Accordingly the application for petitioner no.8/Sabitri Barman is infructuous. 2 This Court is thereafter left to decide the anticipatory bail application of the petitioner no.6/Kamal Barman and petitioner no.7/ Sadhana Barman and petitioner no.9/Pampi Barman @ Pratima Barman Das @ Protima Barman. The submissions of the learned advocate for the petitioners, de-facto complainant and State are considered. I have taken into account the injury report of Jyotish Chandra Barman, Riton Barman, Gopal Barman, Debobrata Barman and Milon Barman. On an assessment of the same, I find that Jyotish Chandra Barman named Kamal Barman as one of the assailants alongwith others. Accordingly the prayer for anticipatory bail of petitioner no.6, namely, Kamal Barman is rejected. So far as the prayer for anticipatory bail of petitioner nos. 7 and 9 being Sadhana Barman and Pampi Barman @ Pratima Barman Das @ Protima Barman is concerned, prima facie, I am of the view that their custodial detention may not be warranted in connection with the present case. Accordingly the prayer for anticipatory bail of petitioner no.7 and petitioner no.9 is allowed. As such, I direct that in the event of arrest, the petitioner no.7/ Sadhana Barman and petitioner no.9/Pampi Barman @ Pratima Barman Das @ Protima Barman be released on bail upon furnishing a bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.
10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the investigating officer/arresting officer of the case
3 and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. This order of anticipatory bail will remain in force for a period of eight weeks. With the aforesaid observations CRM (A) 900 of 2025 is partly allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
