1. The present contempt application has been preferred alleging wilful violation of the judgment dated 2nd May, 2025 passed in a writ petition being WPA 18053 of 2023.
2. In course of hearing, Mr. Ayan Poddar, learned Advocate appearing for the alleged contemnors, places a document and submits that, in compliance with the judgment, the remark ‘Censure’ has been removed from the service records of the applicant/petitioner and that he has been granted notional seniority and notional fixation in E7 grade with effect from 1st March, 2022, i.e. at par with the Executives promoted from E-6 to E-7 grade vide Order No. B-154 dated 1st March, 2022. Consequent upon such notional seniority, the applicant/petitioner shall be placed below Sri Jageshwar Mahilang and above Sri Anand Raghunath Ambedkar. It is also clarified that the actual financial benefits shall accrue to the applicant/petitioner only from the date on which he actually started working in E7 grade. The document as placed by Mr. Poddar is taken on record.

3. Mr. Swapan Kumar Dutta, learned Senior Advocate appearing for the applicant/petitioner, submits that the applicant/petitioner is still entitled to certain consequential benefits.
4. However, in this contempt proceeding, I am not inclined to enter into such dispute. Since the order, violation of which is the subject matter of the present contempt application, has been substantially complied with, I am no longer inclined to proceed with the present contempt application.
5. Accordingly, CPAN 1126 of 2025 stands disposed of.
6. If the applicant/petitioner feels aggrieved by any of the action taken by the respondents/Coal India Limited, he shall be at liberty to take appropriate steps, in accordance with law before the appropriate forum.
