2 Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the Applicants who have been arrested in connection with Crime No.184/2026 registered at Police Station – Malkharauda, Sakti (C.G.), for the offences under Sections 303(2), 324(3), 112 and 3(5) of BNS.

The prosecution case, in brief, is that complainant Ramkumar Sahu, a resident of Village Pihreed and owner of a cloth shop at Mission Chowk, Malkharoda, lodged a written complaint at Police Outpost Malkharoda stating that on 10.05.2026 at about 08:00 P.M., he parked his Baleno car bearing Registration No. CG-11-AZ-6530 in front of his shop and went home. On the following morning at about 05:00 A.M., he found that the rear, side and driver-side window glasses of the car had been damaged and that a jack and spanner kept in the dickey of the car had been stolen. Accordingly, crime was registered against an unknown person under Sections mentioned above. During investigation, it was revealed that Applicant No.1 disclosed in his memorandum statement that he, along with Applicant No.1, Prakash Chandra alias Bittu and Ashish Sagar, had committed theft of the jack and spanner kept in the dickey of the said Baleno car at Mission Chowk, Village Pihreed. An earthen brick piece was also seized from the spot. On the basis of the material collected
3 during investigation, the prima facie involvement of the present Applicants in the alleged offence is stated to be established, accordingly offences were registered against them. Hence, this application.

Learned Counsel for the Applicants submits that the Applicants are innocent and have been falsely implicated in the present case. He further submits that the FIR was initially registered against an unknown person and the Applicants have subsequently been arrested merely on suspicion, without proper investigation or cogent material connecting them with the alleged offence. He further submits that the Applicants are in custody since 23.06.2026, the charge-sheet has not yet been filed and the trial is likely to take considerable time for its conclusion, therefore, they may be enlarged on bail.

On the other hand, learned State Counsel opposes the bail application and submits that the connected matters pertain to the same accused and the bail applications therein have already been rejected. It is further submitted that the present Applicant has as many as 11 previous criminal antecedents and that in respect of three antecedents, the bail applications preferred by the Applicant have already been rejected.
5. Considering the submissions advanced by learned Counsel
4 for the parties, the material available in the case diary, the nature of allegations, the fact that the connected matters pertain to the same accused and their bail applications have already been rejected, the fact that the present Applicant has as many as 11 previous criminal antecedents and out of them, bail applications preferred by the Applicant in respect of three antecedents have already been rejected, this Court is not inclined to extend the benefit of bail to the Applicant. Accordingly, the bail application is rejected.
6. Accordingly, the bail application of the Applicants – Harsh Sidar @ Bittu and Gulshan Bareth involved in Crime No. 184/2026 registered at Police Station – Malkharauda, Sakti (C.G.), for the offences under Sections 303(2), 324(3), 112 and 3(5) of BNS is hereby rejected.
