Learned advocate for the State has produced the case diary. I have taken into account the statement of the witness therein and is of the opinion that the investigation may continue but custodial detention of the present petitioner may not be warranted in the facts and circumstances of the case. 2 Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Debmalya Roy] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner shall once in a week meet with the Investigating Officer (I.O.) of the case till the charge-sheet is submitted. In case, the petitioner do not cooperate with the investigation particularly in respect of attending and/or supplying any relevant materials, in that case, on an application made before the learned jurisdictional court, this order of anticipatory bail will be deemed to be cancelled.
